Living Trusts

An integral part of your estate planning

You are probably familiar with a will, which allows you to transfer your property to beneficiaries upon your death. A will is executed through the legal process of "probate" which is not only time consuming but costly. However a living trust allows you transfer property without the onerous proceedings often encountered during probate. A living trust also allows you to avoid the expense and the administrative proceedings required by a probate court.

A living trust is actually a legal entity, as is a corporation. However this new entity can own property, and is controlled by you because it is revocable during your lifetime.

A living trust is often a difficult topic to discuss, since it is associated with what we don't want to think about. However if you would like complete control over your assets during your lifetime, and want to plan for an easy transference of ownership, consider the benefits of a living trust.

There are many different types of trust and can become very complicated. However a simple living trust, with a pour over will, can ease the transition for your beneficiaries and give you peace of mind now, as you are assured that your assets will be transferred at a minimum of expense and difficulty.

The documents that we will prepare as part of your living trust include:

  1. Declaration of Trust
  2. Assignment of Property
  3. Durable Power of Attorney
  4. Health Care Directive
  5. Pour over will

We can also provide instructional letters to the trustees, make arrangements for the care of pets and construct deeds or transfer documents.

If you would like to find out more information about how a trust can help with your estate plan, please give us a call for your free initial consultation.
